1. Acceptance of Terms

By accessing or using AI Caller services operated by Kraydl LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

AI Caller is an AI-powered phone ordering and communication platform that enables restaurants and food service businesses to automate phone order taking, reservations, and customer communications. Our services include:

AI-powered phone call answering and order processing
SMS order confirmations and payment link delivery
POS system integration (Square, Clover)
Dashboard for order management and analytics
Reservation booking and management

3. User Accounts

3.1 Restaurant Owners

To use our platform as a restaurant owner, you must create an account and provide accurate business information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 End Customers

Customers who place orders by calling a restaurant's AI-powered phone number do not need to create an account. By placing an order, customers agree to provide necessary information (name, phone number, delivery address) and consent to receiving order-related SMS notifications.

4. SMS Communications

Program Name: Kraydl LLC / AI Caller SMS Notifications

Program Description: By opting into SMS messaging during a phone call with our AI ordering assistant, you agree to receive transactional text messages from Kraydl LLC and the participating restaurant. These messages may include:

Order confirmations
Order status updates
Pickup / ready notifications
Payment links

Message frequency varies depending on user activity.
Message and data rates may apply.
To opt out, reply STOP at any time. For help, reply HELP or contact support@kraydl.com.
Consent is not a condition of purchase. You may place an order without opting into SMS.

Carriers are not liable for any delayed or undelivered messages.

SMS Consent & Data Sharing

We do not share, sell, or rent your mobile information or SMS consent data to third parties for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Subscription Plans & Billing

Restaurant owners may subscribe to paid plans (Starter, Growth, Pro) with different AI minute allocations and features. Key billing terms:

Subscriptions are billed monthly via Stripe
A 7-day free trial is provided for new accounts
You may cancel at any time; access continues until the end of the billing period
Refunds are not provided for partial months
Usage exceeding plan limits may result in service restrictions

6. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Attempt to reverse-engineer, hack, or disrupt the platform
Submit false or misleading menu information
Use the SMS functionality for spam or unsolicited marketing
Impersonate any person or entity
Interfere with or disrupt the service infrastructure

7. POS Integration

We integrate with third-party POS systems including Square and Clover. By connecting your POS system, you authorize us to create orders, access menu data, and sync order information. We are not responsible for POS system downtime, API changes, or third-party service issues.

8. AI Service Accuracy

Our AI system processes phone calls and orders with high accuracy but is not infallible. We do not guarantee 100% accuracy in order transcription or processing. Restaurant owners should monitor orders and verify accuracy. We are not liable for incorrect orders resulting from AI misinterpretation.

9. Limitation of Liability

To the maximum extent permitted by law, Kraydl LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability for any claims arising from or related to these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Intellectual Property

All content, features, and functionality of the AI Caller platform are owned by Kraydl LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform or its components without written permission.

11. Termination

We may suspend or terminate your access to the service at any time for violation of these terms, non-payment, or any reason at our sole discretion. Upon termination, your right to use the service ceases immediately. Data may be deleted 30 days after account termination.

12. Modifications

We reserve the right to modify these terms at any time. We will notify registered users of material changes via email. Continued use of the service after changes constitutes acceptance of the modified terms.

13. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable rules.
